If you are a motorcycle rider, then you know there is no better feeling than going on a long summer ride and feeling the wind against your bike and the pavement below. It is a solo experience, but biking is often a group activity. Group riding and motorcycle rallies have long been a part of the biking experience. In addition, many people ride with a passenger. This presents a new challenge regarding motorcycle passenger safety and liability.

The Challenge of Riding with a Motorcycle Passenger

Motorcycle passengers are a safety issue because of the nature of motorcycles. They only have two wheels (in most cases), which means they rely heavily on balance. When another grown person is on a bike, it changes everything. Their movement can throw off your balance, and the weight of the bike will be different. This will cause the bike to handle differently, especially if it is a smaller bike.

Increasing Motorcycle Passenger Safety

However more dangerous it may be to have a passenger on a motorcycle is dependent on many variables, but it is possible to greatly reduce the risk of injury by evaluating and mitigating risk.

Experienced Rider:

The first thing you want to ensure if you are planning on putting a passenger on a motorcycle with you is that you have experience. Typically, over one year of experience is recommended before letting somebody join you. This is because you’ll get to know your bike and how it handles on the road. It will also give you an opportunity to handle hazards, such as semi-trucks and tar snakes, that are inevitable when riding a motorcycle but require experience to handle correctly. A new rider is not equipped to handle everyday hazards with the added challenge of an extra person’s weight on their bike.

Big Bike:

The weight of the bike and the weight of the person will have something to do with the difficulty of riding “2-up.” If you have a larger bike, it will handle weight differentiation better than a smaller bike. The same goes for the pillion, or passenger. A very heavy passenger is going to be harder to handle. It’s something to consider. Two very slight people on a dual sport may be acceptable. Two people weighing over 200 pounds is not going to be easy. There are other things to consider here as well, such as passenger experience.

Signals:

You may have helmets equipped with microphones that enable you to speak clearly with your passenger. However, equipment can malfunction, and sometimes the wind just doesn’t allow equipment to work properly. In addition to the awesome advantages of today’s technology, you should have some other options for communicating with your passenger. This includes hand signals that let the pilot know the passenger needs to stop, etc. Without hand motions, equipment failure can lead to catastrophic circumstances.

Safety Tips:

A run down of safety tips is also essential for a passenger in order to alleviate some of the things that can ruin a ride. This includes telling the passenger not to put his or her feet down at stops and where to hold on for safety. Getting a good feel for the rider’s experience is good as well. Have they ever ridden on the back of a bike? Do they know not to counter or enhance your movement but rather move with you? These things may be obvious to the experienced rider, but you need to make sure you cover all of the basics just in case.

Endorsement:

It is not just the pilot of a motorcycle who needs to be concerned about safety. The passenger should also do his or her due diligence. Check to make sure the rider has a motorcycle endorsement. Florida requires an endorsement on a driver’s license if the engine for the bike is more than 50 cc. This pretty much covers all bikes that one would be willing to ride on the road let alone with a passenger.

Insurance:

Lastly, a passenger should make sure that the owner of the bike is carrying insurance. Florida is the only state that does not require insurance to ride a motorcycle on the open road. Make sure your driver has insurance and that they have guest passenger liability. This won’t protect you if it is someone else’s fault, but if the bike you’re riding on is at fault, you’ll have some coverage for injuries.

Wear Safety Gear:

Every motorcycle recommendation should be equipped with a reminder about the importance of safety gear. If you are over 21 years of age, you don’t have to wear a helmet in Florida. However, you must then carry some medical coverage in case of injury. In truth, everyone should be wearing helmets, and that includes passengers. Safety experts also recommend protective boots and clothing that can prevent road rash in some crashes. These injuries can be deadly, but even when they are not, they are painful and lengthy. Safety gear can limit a lot of the risk.

What to do if you have been in an accident?

If you are in an accident on a motorcycle, and it is not your fault, it is important to gather as much evidence as possible in order to prove that the court should hold the other party liable. This may include taking pictures, collecting contact information from witnesses, and taking photos of injuries. If you end up in the hospital, try to contact somebody who can do this for you while you are incapacitated.

Next, hire a lawyer who is experienced in personal injury law. They will know how to get you just compensation through the courts while ensuring that your medical bills get paid, and your non-monetary losses are considered.

Comparative Fault

If you feel that the accident you were in could have been caused by you, but only in-part, you may still have a case. Florida is a comparative fault state, which means your damages will only be reduced by the amount for which you were held liable. If you were more at fault then the other party, then it may not be worth filing a lawsuit. However, discuss this with your lawyer first to make sure you understand all of your rights.

Motorcycle Passenger Safety is Critical

The responsibility a rider takes on when they agree to have a passenger aboard is great. If you are going to ride with someone, make sure you are taking every safety precaution. It starts with understanding how to ride with a passenger, and if you are inexperienced, please take extra caution. It then is very important that you and your passenger wear safety gear and have proper insurance should the unthinkable happen.

The riders (and passengers) involved in motor vehicle accidents rarely go unscathed. This is why it is critical that you and your motorcycle passenger talk to each other about safety concerns and make sure you have a plan for the safest trip possible. The only fun motorcycle ride is one where everyone makes it home okay. Remember this when you begin your ride, and it will help you to make better decisions.

If you have been involved in a motorcycle accident, please contact the offices of Kirshner, Groff, and Diaz for a case review. We will give you a no-obligation consultation with a real attorney to see what kind of compensation you could be entitled to.

Improve Your Night Vision

Oncoming headlights can be blinding, and because you are sitting a little higher than most cars, they are even more so. Looking at the farthest right line at the edge of the road on your side of the road is one possibility. This can help keep you traveling the right way and in your lane by reducing the amount of light beaming in your eyes. Do not glance down or away, since it will make it difficult for you to stay in your lane.

Ride in the Light

During the dark hours of the day, the lights on your motorcycle only extend so far in front of the bike, limiting your visibility. Your motorcycle has amazing stopping power and can stop in a short distance, but you will need additional stopping distance to avoid any obstructions up ahead. Because you can’t see miles ahead of you at night, limit your speed. It is time to take it slower if you find yourself out-riding your light.

Use the headlights of other vehicles as an extension of your own. If you are following a car ahead, keep an eye out for debris in the road, potholes, and other hazards that their headlights may reveal. Also keep in mind that cars can straddle road detritus that you can’t, putting your safety at risk. Be prepared to navigate around it or change lanes to entirely escape it, if you spot something.

Another thing to remember about your visor is that it must be regularly cleaned. Prevent micro-scratches on your visor using a simple cleaning solution and a cotton or microfiber cloth. Micro-scratches can obscure the visor and distort vision through it over time. The visor should not be scratched with cloth towels.

Tinted Visors or Glasses for Night

Riding at night with a dark, tinted visor is not recommended, but there are some alternatives that can help. During low-light hours, such as dusk, a yellow-tinted visor or glasses can be worn. There are also photochromic visors that adjust to light levels throughout the day for individuals who do not want to worry about carrying an extra visor to swap out from day to night. You can also bring an extra pair of clear glasses to wear at night when riding with the visor down. There is no one-size-fits-all solution that will work for every rider, so try a few different things to see what works best for you.

Fog brings condensation, which can coat your windshield, visor, and rear-view mirrors in a film of moisture. This can be inconvenient for your ride because it obstructs your vision.

This is the final part of our series on riding long distances. We’ve already discussed in the previous parts how to prepare your bike and yourself for a long journey. Now that you are prepared, it is time for your big trip. Of course, you have to pack for your journey, but what should you bring? How can you keep yourself safe on the road? This all depends on the type of trip you are taking and where you are going. However, there are some standard things you should remember when hitting the road on a long-distance journey. Read on for some tips on how to be prepare for anything the open road throws at you.

While biking at night is not always possible to avoid, it all boils down to one thing: visibility. You must be visible to other motorists and other objects in the area, and you must be able to see what is going on around you. In this series, we will discuss the important things to keep in mind in order to stay safe when riding at night.

If poor visibility is a major factor in nighttime motorcycle accidents and fatalities, there are various things you can do to improve visibility and make evening motorcycle riding safer. Here are a few things you can do to improve nighttime riding safety:

High Visibility Clothing/Gear: Take advantage of the fact that your body is entirely visible to other drivers by wearing apparel that is easily seen in low light levels at night. Motorcyclists who wear high-visibility or fluorescent clothes are much less likely to be involved in a motorcycle accident.

Wearing vivid hues like neon yellow, green, orange, or even white will make you more visible than if you are dressed entirely in black. Most essentially, make sure your motorcycle clothing contains retro-reflective panels that shine when exposed to light from your headlights, as this will be the most noticeable part of you when riding.

You can buy a neon industrial safety vest, which is typically worn by construction workers, if you do not want to invest in hi-viz gear or you do not think you will need or wear it often. Choose a vest that is neon yellow or orange, and make sure it has reflective panels!

Reflective Tape & Decals: For extra visibility, make your motorcycle and/or your gear more visible by using retro-reflective tape that will attract other drivers’ attention. To spruce up your gear, you can buy a roll of tape in almost any color you can think of. Use your imagination while placing the tape; you can put it along the edge of your bike, on your forks, along with your panniers and saddlebags, or even on the lip of your wheel rims, if you want to go all out. For those who wish to add more graphics to their motorcycles, armor, or helmet, reflective decals are also available.

Lighting Options: When it comes to lighting on your motorcycle, there are plentiful options available.

LED Lights: Although standard incandescent bulbs are bright, upgrading to an LED light bulb will improve your visibility to other drivers and help you to see farther and better at night. LED lights can produce greater light with less power from the motorcycle and without the additional heat that a higher wattage incandescent bulb produces. Just be sure your motorcycle flasher can compensate for the lower resistance caused by adding or replacing bulbs with LEDs. To compensate for the change in bulbs, you may need to replace your motorcycle’s flasher with an electronic flasher rather than a resistance flasher.

Rather than having a continuous light, it will flash a few times to attract the attention of the motorist behind you before remaining illuminated.

Headlight Modulator: By pulsing your low beam headlights, a headlight modulating kit can attract the attention of oncoming motorists. With so many new cars equipped with daytime running lights, your headlight can get hidden in a sea of them at any time of day. A pulsing light cuts through the multitude of lights, giving you the extra focus you need to stay safe. Although some drivers may find it distracting, it simply demonstrates that it is working — you are being noticed!

Auxiliary Lights: Aside from replacing the OEM bulbs with LED replacements, there are a plethora of custom lighting solutions for increased visibility on your motorcycle. The style of lighting you should use is determined by the goal you are attempting to achieve. You can, for example, add lights to help you see farther down the road for safer night riding, to increase your eyesight in foggy circumstances, or to brighten up the areas in your peripheral vision. You can add single bulbs or numerous strips in multiple colors, and some kits even have a smartphone app that allows you to change the colors on the go.

High Beams: High beams during nighttime riding can be beneficial to motorcyclists, but it is a hotly debated topic. Other automobiles turning left in front of a motorcycle is one of the top causes of accidents; therefore, flashing high beam lights can warn drivers of their action of cutting off a motorcycle.

With your creativity, you can aid your visibility beyond switching to LED lighting and adding retro-reflective gear and designs. Take a step back and examine your motorcycle. What would pique your interest the most? If it attracts your attention, it will also catch the attention of other drivers!

You’ve got the right bike, and it is fully outfitted for your long-distance trip. Are you ready to go? Not quite! There is some preparation you as a rider must do to make sure everything goes as smoothly as possible. Tempting as it may to just hit the road and ride, a little bit of extra planning will go a long way in making your experience easier and more enjoyable. Continue reading below to learn about the preparations you can take for your body and your trip ahead of a long journey on your motorcycle.

Riding Posture

In the last post, we talked about the different kinds of bikes for long-distance rides and modifications you can add to your bike to make the ride more comfortable. However, it is important to remember that there is a delicate balance between comfort and control. During your long-distance ride, you need to make sure you have enough support so you can ride for a long time without discomfort that will affect your safety, but you also need to make sure you have to ability to quickly react to things that happen while riding.

If you have a more reclined riding posture, you may not be able to react quickly to obstacles, but if you are too hunched forward, you will likely not be very comfortable for multiple hours of riding. The best option is to sit in a neutral position and keep your muscles loose and relaxed, while ready to react. Your handlebars should allow you to rest your hands midway between your stomach and your shoulders, with relaxed arms.
Knowing where you want to go is only half the battle. While a long road trip should be fun and leave room for detours and spontaneous scenic routes, it is important to plan ahead and make sure you know enough about the general area where you’ll be riding so you can make good and safe decisions and bring the right gear.

You can use a regular paper map, or with technology these days, you can easily affix a phone or GPS to your bike with a holder. Figure out the minimum amount of time it will take to get to your final destination and compare that to how many hours or days you have available to travel. Figure out which stretches you would ideally like to take the scenic route and where you might need some extra time, and which parts you can ride on the interstate. If you are riding in more remote areas, make sure you take note of where gas stations are and how many miles are between them when they are sparse. You may consider carrying some extra gas with you for emergencies.

Even here in Florida, it is easy to be surprised with a sudden downpour, so make sure you pack accordingly. Even if it is summer and warm, you may want to bring warmer layers if you will be riding at night. Be particularly aware of weather and temperature changes if you are riding through mountainous areas or other topography changes, where climate can shift in a matter of minutes. It is always better to be prepared with the proper gear and clothing and never use it than to be caught without it when you need it most.

This also gives you a target goals for miles for the day. If this is not possible, make sure you have backup options, and look for alternative accommodations along your route, in case you overestimate the mileage you can endure in a day.

The rate of traffic deaths jumped in the first half of 2020, and safety experts blame drivers who sped up on roads left open when the COVID-19 pandemic shut down businesses and limited commuting.

The new research also suggests that even small increases in speed led to much deadlier outcomes in vehicle crashes.

A crash that is easily survivable at 40 mph miles per hour can be fatal at 50 mph or more, according to the study conducted by the Insurance Institute for Highway Safety and the AAA Foundation for Traffic Safety.

The results are particularly disquieting due to widespread reports of excessive speeding during the pandemic.

When the pandemic significantly lowered traffic, the rate of traffic fatalities per miles driven jumped by 18%, reaching a level not seen in at least 12 years, according to the National Highway Traffic Safety Administration. Safety experts have blamed speeding for the increase as reduced congestion gave motorists more room to roam.

Stop raising speed limits

IIHS President David Harkey said the group’s latest study results show that policymakers should refrain from further increases to maximum speed limits on highways and freeways.

“Small changes in speed when you’re involved in a crash can really increase your chances of getting a severe injury” or dying, he said. “It’s a huge problem.”

The study examined the performance of a 2010 model-year compact SUV under the premise that it is generally representative of the average vehicle on the road today. Research firm IHS Markit recently reported that the average vehicle is nearing 12 years old.

To ensure the results weren’t skewed by a vehicle with poor safety ratings, researchers picked the 2010 Honda CR-V EX because it earned the highest possible score in the IIHS moderate overlap front crash test.

Speed increases injuries

The study found that at 40 mph, the driver of the Honda CR-V experienced “minimal intrusion.” But at 50 mph, “there was noticeable deformation of the driver side door opening, dashboard and foot area.” And at 56 mph, “the vehicle interior was significantly compromised, with the dummy’s sensors registering severe neck injuries and a likelihood of fractures to the long bones in the lower leg.”

In the 50 mph and 56 mph crash tests, the dummy’s head went through the deployed airbag, smashing into the steering wheel and suffering what would likely be facial fractures or a severe brain injury.

IIHS typically runs crash tests at 40 mph but increased the speed for this study to show the impact of high-speed collisions.

Although newer vehicles might be safer, Harkey said they probably wouldn’t fare too much better.

“The crashworthiness aspects of the design … haven’t changed much” for this type of collision, he said.

Higher speed limits mean more deaths

In 41 states, the maximum speed limit is 70 mph or higher. That includes eight states with maximum speeds of 80 mph or more.

Increases in speed limits have resulted in nearly 37,000 additional deaths over the previous 25 years, an IIHS study released in 2019 reported.

Harkey advocated for more speed cameras and enforcement.

Jake Nelson, AAA director of traffic safety advocacy and research, advocated for policymakers to take steps to reduce traffic speeds.

They “should consider infrastructure changes based on road type to calm traffic flow appropriately so that posted speed limits are followed,” Nelson said in a statement.

First-degree is the least severe, while third-degree is the most.

A first-degree road rash affects only the top layer of the skin. This category includes milder wounds like scrapes, scratches, raspberries, and other superficial minor injuries. These can be identified by reddened skin and possible temporary scarring, but these should usually heal over time with adequate disinfectant and treatment.

Second-degree road rash is an abrasion that results in the top layer of skin, the epidermis, being torn and causes a deep cut or laceration. Since this level of injury breaks the skin barrier, the victim is more susceptible to possible infection, which can cause complications, so it is important to be treated by a professional to make sure you don’t miss anything.

The most severe case, third-degree road rash, occurs when the second layer of skin, the dermis, is penetrated and peeled away. The dermis covers everything under the skin, so if this layer is damaged, the injury may expose fat and muscle tissues. This can result in nerve damage, impaired muscle and tendon function, or permanent deformity. Needless to say, this grade of injury requires immediate medical attention and can necessitate reconstructive surgery or skin grafts.

One of the saddest things we hear from drivers who have struck a motorcycle is that they never even saw the person riding. As a rider, you must remember that the ease and efficiency that comes with a smaller vehicle also presents a large danger to the rider, in that it is more difficult for other drivers to see you while you are riding, especially at high speeds. Luckily, there are many precautions you can take to ensure you are as safe on the road as you can be. Read on to find out how to improve your visibility while riding and stay as safe as possible.

Be Aware of Your Surroundings

One of the biggest mistakes a motorcyclist can make on the road is to assume that every other vehicle can see them. It can be easy to get swept up in the joy of riding or the monotony of a daily commute and forget that you are not as visible as larger vehicles. Do not be lulled into a false sense of security that you are safe on the road and others will notice you.

As a motorcyclist, you may be used to being more vigilant while driving, but you cannot assume the other cars on the road are doing the same, or even that they have the same viewpoints and visibility as you. Do not rely on others to see you first and be aware that other drivers may not fully understand that what is a minor obstacle for a car can spell out major danger for a bike. Poor weather conditions like rain, or even harsh sunlight, can make it difficult for drivers to see you as well.

Wear Visible Clothing

Putting on a brightly-colored piece of clothing as your top layer can go a long way in increasing your visibility to other drivers. Neon colors stand out to drivers, especially yellow, which is the first color to register in the human brain. You could also consider wearing a reflective vest or other accessories to make you more easily seen in poor conditions or at night.

Choose Your Bike Color Wisely

Black bikes may look sleek and cool and hide dirt and marks well, but this is the least visible color you could choose for your bike. Even in the daytime, this color tends to blend in with its surroundings. Consider choosing a brighter color, like white, red, or yellow, for your bike. Alternatively, you could add bright accessories, decals, or racing stripes. Any bold color on your bike will help create contrast and visibility.

Use Reflectors on Everything

Applying reflective tape and decals to your clothing, accessories, and bike are fundamental to making sure drivers and pedestrians can see you on the road. It is a good idea to put some on your helmet and the back of your boots. Reflectors on your gloves can make it easier for others to see your hand signals.

As for your bike, you want to outline as much of it as possible so cars can tell where you are and better recognize you as a motorcycle. Apply it on the front, sides, and back of your bike, as well as around the rims of your wheels. It is also a best practice to put some reflectors on your forks and any other piece of your bike that sticks out, especially if it is far from a light source. This can help your bike look larger at night, which will make you easier to spot and more likely to get a wider berth.

Take Note of Your Blind Spots

It is important to remember that drivers of other vehicles have blind spots. If you are in the area around the back half of the vehicle and to the side, and you cannot see the driver, there is a very high chance that they cannot see you or your bike either. Try not to spend time in this area for too long. Even if a driver was able to see you approach, if they haven’t been able to see you for a while, they might not remember you are there. Speed up to pass them or slow down to let them stay a healthy distance ahead of you.

Make sure you can see all of the drivers of the vehicles around you. If you can make eye contact with them through their mirrors, you are more likely in their line of sight. Don’t follow too close to vehicles ahead of you, and pass quickly and predictably.

As a motorcycle rider, you may have the luxury of driving anywhere in the lane, but that doesn’t mean you should. If you are on your bike, try your best to stay on the left side of the lane, closest to the center line. This is the most visible place for you to be seen by vehicles in front of or behind you and by oncoming traffic. You will also have more time and room to see onto side streets and around bends.

Even though you may have headlights that are running all the time while riding, you might consider turning on your high beams to make yourself even more obvious. Motorcycles can accelerate and approach fast, and if your lights are not very strong or positioned too low, a driver may not see the beam well. High beams can help with this problem, and they can help you be seen when road glare reduces visibility. If you are riding at night, be sure to turn them down as your approach oncoming traffic if they are blinding other drivers.

If you have an older vehicle without, make sure to install running lights that are on all the time when you are driving. Even new bikes come with far fewer lights than cars, so it can be a great safety measure to add additional aftermarket lights on your motorcycle. This can expand your visible field to other drivers and can help them distinguish you as a motorcycle, rather than a bicycle or something stationary. The right lighting can also help oncoming vehicles better predict the speed at which you are approaching.

Brake lights are one of the most visible areas on your bike. If you are concerned a car is following you too closely, tap your brakes gently (without braking suddenly). The driver may not have noticed your bike or they may not have realized they were not a safe distance away from you. Turning on your brake lights is a quick and effective way to get their attention.

In Florida, we enjoy many freedoms and benefits to riding motorcycles. There are still important laws you need to know and follow, though, and because of the unique nature of a bike, there are more specialized rules to remember. Florida has the second-highest number of registered motorcycles in the country, but it is also near the top of the list for motorcycle fatalities.

The laws are designed with you and everyone else’s best interest in mind, so it is important to be aware of the laws, regardless of if you are a new rider or an experienced veteran. It can be a little confusing to keep track of all the rules, so we have aggregated several of the legalities pertaining to motorcycle riding here in Florida for your ease.

As opposed to driving a car, there are a few more details you need to think about when operating a motorcycle. Since you are exposed to the elements and more vulnerable in case of accident, Florida has laws about protective equipment in order to keep you and others safe and vigilant.

Florida’s Road Rules for Motorcycle Riders

In Florida, the traffic laws apply to every operating vehicle equally, whether it is a car, motorcycle, cargo truck, or anyone else who might be on the road. As a motorcyclist, this means that you are not allowed to weave in and out of traffic, and you must maintain the appropriate speed with the flow of traffic and obey all traffic signals in the same way.

However, since the same rules of the road apply to you as a rider, you also are entitled to the same rights as any other driver on the road. You have the right to use the full lane of traffic, although two motorcyclists are allowed to share the same lane if they so choose. Cars must allow you your own lane and must maintain the same safe distance as with any other vehicle.

This also means that lane splitting is not permitted. You may not ride alongside another car in traffic, and you cannot pass between lanes, whether or not traffic is moving. As of the time of writing, California is the only state where lane splitting is legal.

Motorcycle Insurance Requirements in Florida

When it comes to vehicle insurance, Florida is a no-fault state. This means that when an accident occurs, it is the responsibility of the driver found to be at fault to pay for any injuries or damages incurred by the other driver. This could be applied to just one driver. If the accident was caused by more than one driver or both parties are found partially at fault, the responsibility could also be split.

For other registered vehicles in Florida, there is a requirement to carry Personal Injury Protection (PIP) insurance, which pays for your own medical expenses, regardless of fault, but this rule does not apply to motorcycles.

Florida does have a Financial Responsibility law, which requires motorcyclists to either obtain a self-insurance certificate from the Bureau of Financial Responsibility or to have proper insurance coverage. The minimum requirements for riders are $10,000 (or $20,000 for 2+ people) for bodily injury and $10,000 per crash for property damage.

It is important as a motorcyclist to know the rules of the road and to follow them. Knowing and abiding by these laws, which are designed to keep you and other safe, could be the difference between a close call and a fatal wreck.

You may think you could use the services of a lawyer for your case, but motorcycle accidents can become a lot more complicated than simple car accidents. Unfortunately, there is sometimes a tendency among police, witnesses, and the other involved party to hold bias against motorcycle riders in an accident.

Because motorcycles are viewed as more dangerous, riders can get a bad reputation for being reckless, which is typically just not true. Motorcycle operators are no more likely to be irresponsible than any other driver on the road. If you do your best to follow the rules of the road, you are that much more able to fight against this bias.
